General information on data processing

We process data as part of our website operation.

This includes disclosing data to third parties and, where necessary, to "third countries" outside the European Union ("EU") and the European Economic Area ("EEA"). We have indicated below when we pass on data to countries outside the EU or the EEA.

4. Data processing

The specific data concerned, processing purposes, legal bases, recipients, and any disclosures to third countries are listed in the sections below:

a) Log file when you visit our website

We log your visits to our website. As part of this, we process:

  • Name(s) of our web page(s) you access,
  • Date and time of access,
  • The volume of data transferred,
  • The browser type, including the version,
  • The operating system you use,
  • The referrer URL (the site visited beforehand),
  • Your IP address,
  • The provider making the request.

The legal basis for data processing is our overriding legitimate interest, in accordance with Art. 6(1) f) GDPR, in the continued provision and security of our website.

The log file is deleted after seven days unless it is needed to provide evidence of or clarify specific breaches that have come to our attention within the retention period.

b) Hosting

To provide our online offering, we use services from web hosting providers who we commission to process the above-mentioned data as well as all data to be processed in connection with the operation of this website (log file when you visit our website).

The legal basis for data processing is our overriding legitimate interest, in accordance with Art. 6(1) f) GDPR, in the provision of our website.

c) Making contact

If you contact us, we process the following data that you supply so that we can handle your inquiry: Name, contact details (if supplied by you), and your message.

The legal basis for data processing is our obligation to perform a contract and/or to meet our obligations prior to entering into a contract in accordance with Art. 6(1) b) GDPR, and/or our overriding legitimate interest in handling your inquiry in accordance with Art. 6(1) f) GDPR.

d) Making contact to apply for a job

If you contact us to apply for a job by email or via a contact form, for example, we will process the data you supply (e.g., name, email address, preferred place of employment), your message, and your accompanying application documents exclusively for the purpose of handling your application.

The legal basis for data processing is primarily Section 26 of the German Federal Data Protection Act (BDSG). This permits data required for decisions on the establishment of an employment relationship to be processed.

Should the data be needed for legal proceedings after the completion of the application process, data processing may take place to preserve our legitimate interests in accordance with Art. 6(1) f) GDPR, namely to assert and/or defend against claims.

e) Newsletter

To give you regular updates about our company and offers, we provide an email newsletter service. If you register to receive our newsletter, we will process the data you supply during registration (email address and other voluntary information). To prevent misuse, we will send you an email after you register, in which we will ask you to confirm your registration (double opt-in procedure). We will log your registration so that we are able to provide legally-compliant evidence of the registration process. The log will include your registration and confirmation date/time and your IP address.

The legal basis for sending the newsletter is your consent in accordance with Art. 6(1) a) GDPR. The data processing required for sending the confirmation email for your registration and the associated data logging is carried out on the basis of Art. 6(1) f) GDPR and our legitimate interest in providing evidence that you have registered properly.

f) Cookies

We use cookies on our website. Cookies are small text files that are set on your device (PC, smartphone, tablet, etc.) and stored by your browser.

Purposes

We use strictly necessary cookies to ensure our website functions properly. These cookies make it possible to navigate our website, for example, or to offer other basic website functions.

We also use optional cookies that give us extra information, for example to analyze data traffic or for advertising and marketing purposes.

Duration

The cookies used remain on your device for different lengths of time:

Session cookies: These cookies are erased from your device immediately when you close your Internet browser.

Persistent cookies: These cookies remain on your device even after you close your web browser and enable us to recognize you the next time you visit our website, for example.

Cookie providers

Cookies that we set directly are called first-party cookies. Third-party cookies, on the other hand, are set by external websites, for example when content is displayed (ads, images, tracking pixels, etc.).

Legal basis for data processing

The following general rule applies: The legal basis for data processing using a cookie is your consent in accordance with Art. 6(1) a) GDPR or our overriding legitimate interest in properly operating and optimizing our website in accordance with Art. 6(1) f) GDPR.

Withdrawal and objection

If data processing is based on your consent, you can withdraw your consent (i.e., opt out) at any time and this will take effect for the future. If data processing is based on our legitimate interest, you can object to the continuation of data processing with effect for the future.

You can withdraw your consent using the opt-out link in the Privacy Policy section for the service in question or you can adjust your preferences in our Cookie-Informations https://www.weller-tools.com/cookie.html.

You can find information on objecting to data processing in section 8 b) of this Privacy Policy.

Controlling cookies in your browser settings

You can also stop or restrict data processing through cookies in the future by going to the relevant browser settings and disabling cookies, for example. Cookies that have already been stored can be erased in your browser settings. You can find further information on browser settings by clicking on the following links:

Cookiebots consent banner

To document your settings for specific data processing processes that use cookies and to communicate them to third parties if you have given consent, we use the Cookiebot service, Cybot A/S. Havnegade 39, 1058 Copenhagen, Denmark ("Cybot") on our website.

When you select your cookie preferences via the cookie consent provided, Cybot automatically logs the following data:

  • The IP number of the end user in anonymized form (the last three digits are set to "0").
  • Date and time of your consent.
  • User agent of the end users browser.
  • The URL from which the consent was issued.
  • An anonymous, random, encrypted key.
  • The end users consent status, which serves as evidence of consent.

The key and the consent status are stored in the "CookieConsent" cookie on your browser, so that our website can automatically read and follow your settings every time you access our website and in every future end user session for up to 12 months. The key is used to provide evidence of your consent and settings and as an option to check whether the consent status stored on your browser has changed compared with the original consent communicated to Cybot.

The data processing is performed to meet our legal obligation to process data lawfully in accordance with Art. 6(1) c) GDPR.

Our cookies

You can find further information on the specific cookies set, their purposes, and their duration in our Cookie-Informations https://www.weller-tools.com/cookie.html

g) Analysis/marketing

aa) Google services

We use various services from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google") on our website. Data may also be transferred to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 in the USA.

Google guarantees an adequate data privacy standard through EU standard contractual clauses. You can access a copy of the contractual clauses here: https://policies.google.com/privacy/frameworks?hl=de&gl=de

Google Analytics

We use Googles tracking tool, Google Analytics, on our website. We use Google Analytics to analyze your use of our website, to create reports on activities within our web offering, and to provide further services associated with the use of our website to make it more user-friendly.

When Google Analytics is used, interaction from visitors to our website is primarily logged using cookies and analyzed systematically.

You can find details of the cookies used in our Cookie-Informations https://www.weller-tools.com/cookie.html

We use Google Analytics with the "anonymizeIp()" feature. This abbreviates IP addresses in EU Member States or the EEA. If data is transferred to Google servers in the USA, your full IP address is only transmitted and abbreviated there in exceptions. This prevents any direct reference to individuals as a rule. In particular, it is not possible to identify the computer or device used by the websites visitor.

The following data is processed through our use of Google Analytics:

  • 3 bytes of the IP address of the website visitors system (anonymized IP address),
  • the website accessed,
  • the website which the user visited directly before accessing the page on our website (referrer),
  • the subpages accessed from the website,
  • the time spent visiting the website,
  • the frequency of visits to the website.

According to Google, under no circumstances will it link your IP address to other data held by Google.

The legal basis for the data processing is your prior consent in accordance with Art. 6(1) a) GDPR.

Withdrawing your consent

You can withdraw your consent at any time with effect for the future by adjusting your preferences in our Cookie-Informations https://www.weller-tools.com/cookie.html or the setting options at http://www.google.de/ads/preferences.

Please also note the information on Googles use of data in the Google partner network at: http://www.google.com/intl/de/policies/privacy/partners/

5. Social media plugins

We use third-party plugins on our website. This allows you to tell your contacts whether you like our website and to link to or share content. The plugins are shown by the logo of the third-party provider in question.

When you visit our website, your data is transferred to the relevant third-party providers.

If you are registered with one of the third-party providers, the data may be assigned to your user account with them.

In some cases, this data may also be transferred to the third-party providers even if you are not a registered user of the third-party providers and do not click on the plugin on our pages.

However, if you are not registered with the third-party provider(s) and your data is transferred to them, it is not directly possible to establish a reference to you, e.g., via your IP address; this would only be possible through information from your provider.

Please refer to the individual third-party providers privacy policies for information on the purpose and extent of their data processing.

This data is processed on the basis of our overriding legitimate interest in optimum marketing of our online offering in accordance with Art. 6(1) f) GDPR.

  • AddThis-Plugin, Oracle America Inc., 500 Oracle Parkway, Redwood Shores, CA 94065, USA.

6. Data retention period

We store personal data only for as long as required for the purposes for which it is processed or until you have withdrawn the consent you had granted. If we are required by law to comply with specific data retention periods, the retention period for certain types of data may be up to 10 years regardless of the processing purposes.

7. Your rights as a data subject

a) Disclosure

On request, you can obtain information at any time about all of the personal data we hold that relates to you, at no charge.

b) Rectification, erasure, restriction of processing (blocking), objection

If you no longer agree to the storage of your personal data, or if your data has been stored incorrectly, we will, once notified of this, arrange for your data to be erased or blocked or make the necessary corrections (to the extent possible under the applicable law). This also applies if we are to restrict the processing of your data in the future. You have a right to object particularly in cases where your data is required to undertake a task in the public interest or in our legitimate interests, including profiling based on this. You also have a right to object if data processing is undertaken for the purpose of direct marketing.

c) Right to object with effect for the future where you have given consent

You may withdraw consent you have granted at any time with effect for the future. Your withdrawal will not affect the legitimacy of the processing up to the time of withdrawal.

d) Data portability

You have the right to data portability if data is processed on the basis of a contract, negotiations conducted prior to a contract being concluded, consent, or an automated process. On request, we will give you your data in a commonly used, structured, machine-readable format, so that you can transmit the data to another controller if you wish.

e) Right to lodge a complaint

You also have the right to lodge a complaint with a supervisory authority regarding your rights as a data subject:

f) Limitations

Data that does not allow us to identify the data subject, for example data that has been anonymized for analysis purposes, is not covered by the above-mentioned rights. Disclosure, erasure, blocking, rectification, or transmission to another company may be possible for such data if you provide additional information that allows us to identify you.

8. Exercising your rights as a data subject

If you have any questions about how we process your personal data or about disclosure, rectification, blocking, objection, or erasure of data, or if you wish to transmit your data to another company, please contact Datenschutz@ApexToolGroup.com
